These Terms and Conditions govern the provision of qualifications, assessment services, and related products offered by ParaQual ("we", "us", or "our"). By registering for a qualification or using our services, you agree to be bound by these Terms and Conditions.
Terms and Conditions
1. Our Services
ParaQual provides registration, learner support, assessment services, online learning resources, and administration for vocational and professional qualifications offered through recognised awarding organisations.
Successful registration does not guarantee successful achievement of a qualification. Learners must satisfy all assessment and quality assurance requirements before certification can be awarded.
2. Eligibility
It is the learner's responsibility to ensure that they are suitable for the qualification they wish to undertake.
Some qualifications require access to an appropriate workplace role and the ability to generate sufficient evidence of competence. We reserve the right to request additional information to confirm eligibility.
If we determine that a learner does not meet the requirements for a qualification before assessment activities commence, registration may be cancelled.
3. Registration
Registration is normally completed once:
- The required fee or agreed instalment has been paid;
- Required registration information has been provided; and
- Any requested identification documents have been received.
We reserve the right to refuse or cancel registration where false, misleading, or incomplete information has been supplied.
4. Fees and Payment
Qualification fees are published on our website and may be updated from time to time.
Where instalment plans are offered:
- The learner remains responsible for payment of the full agreed amount.
- Missed payments may result in suspension of services or withholding of certification until outstanding balances are settled.
All fees are stated in Pounds Sterling (GBP) unless otherwise specified.
5. Refunds
Refunds are governed by our published Refund Policy.
In general:
- Consumers may have cancellation rights under applicable UK consumer legislation.
- Refunds may not be available where assessment services have commenced or where the statutory cancellation period has expired.
- Once an assessor has started providing personalised assessment services, eligibility checks, induction, evidence review, or feedback, refunds may no longer be available.
Nothing in these Terms affects your statutory consumer rights.
6. Assessment
Assessment methods vary depending on the qualification but may include:
- Workplace evidence;
- Written responses;
- Professional discussions;
- Assignments;
- Examinations; or
- Other assessment methods specified by the relevant awarding organisation.
Learners must satisfy all required learning outcomes and assessment criteria before a qualification can be achieved.
7. Learner Responsibilities
Learners agree to:
- Provide accurate registration information;
- Cooperate with assessors and quality assurance personnel;
- Submit evidence within agreed timeframes where reasonably possible;
- Maintain respectful and professional conduct;
- Protect login credentials for online systems; and
- Comply with awarding organisation requirements.
8. Authenticity of Evidence
All submitted evidence must:
- Be genuine;
- Be the learner's own work;
- Accurately reflect workplace activities; and
- Demonstrate the learner's own competence.
Fabricated, falsified, or misleading evidence may result in rejection of submissions, cancellation of registration, or reporting to the awarding organisation.
9. Artificial Intelligence (AI) and Third-Party Assistance
Learners may use AI tools or third-party resources for learning and research purposes. However:
- Submitted evidence must accurately represent the learner's own competence.
- AI-generated or third-party content must not be used to misrepresent practical ability or workplace performance.
- Workplace evidence must remain authentic.
ParaQual reserves the right to investigate suspected misuse of AI or third-party assistance.
10. Plagiarism and Malpractice
Plagiarism, impersonation, contract cheating, falsification of documents, or any other dishonest conduct constitutes malpractice.
Where malpractice is identified, ParaQual may:
- Reject evidence;
- Suspend or terminate registration;
- Report the matter to the awarding organisation; and
- Refuse certification.
No refund will normally be provided where registration is terminated due to malpractice.
11. Confidential Information
Learners should anonymise confidential information where appropriate before submission.
By submitting evidence, learners confirm they have appropriate authority to share the material for assessment purposes.
ParaQual will treat learner information confidentially but may disclose portfolios to awarding organisations, Internal Quality Assurers (IQA), External Quality Assurers (EQA), regulators, or other authorised bodies where necessary.
12. Assessor Decisions
Assessors may:
- Accept evidence;
- Request clarification;
- Request additional evidence;
- Provide feedback for improvement; or
- Require resubmission.
Assessment decisions remain subject to internal and external quality assurance processes.
12A. Assessor Feedback Timescales
ParaQual aims to provide timely feedback on learner submissions and, in most cases, assessors will review and respond significantly sooner than the maximum period stated below.
However, learners acknowledge that an assessor may take up to 10 working days to provide feedback on a submission. This extended review period is uncommon but may occasionally be necessary, particularly where:
- multiple submissions have been made against the same assessment criterion without sufficient improvement;
- additional review or clarification is required to ensure that awarding organisation standards are met;
- the assessor needs to evaluate complex or extensive evidence; or
- exceptional operational circumstances arise.
Learners are encouraged to carefully consider assessor feedback before resubmitting evidence to minimise delays and facilitate efficient progression through the qualification.
13. Quality Assurance
Learners acknowledge that their work may be sampled by Internal Quality Assurers, External Quality Assurers, or awarding organisation representatives.
Learners may be contacted to verify the authenticity of submitted evidence or confirm assessment activities.
14. Qualification Completion
Learners are responsible for progressing their qualification within the applicable registration period.
Failure to complete within the registration period may require an extension fee, re-registration, or other arrangements in accordance with provider policy.
15. Certification
Certificates will only be issued after:
- Successful completion of all assessment requirements;
- Completion of required quality assurance processes; and
- Settlement of any outstanding fees.
ParaQual cannot guarantee certification where awarding organisation requirements have not been satisfied.
15A. Certificate Issuance and Awarding Organisation Delays
ParaQual will submit successful learner portfolios for certification in accordance with the relevant awarding organisation's procedures. While we endeavour to facilitate certification promptly, the final issuance of certificates is controlled by the awarding organisation and may be subject to its own quality assurance and administrative processes.
In rare cases, certificate issuance may be delayed due to factors outside ParaQual's reasonable control, including but not limited to:
- External Quality Assurance (EQA) visits or sampling activities;
- awarding organisation verification procedures;
- administrative processing times;
- regulatory requirements; or
- operational issues affecting the awarding organisation.
ParaQual shall not be liable for delays in certificate production or dispatch that are attributable to the awarding organisation or other third parties, provided that we have fulfilled our own obligations in a timely manner. We will, however, make reasonable efforts to keep learners informed of any significant delays and assist in resolving certification queries where possible.
16. Online Platform
Learners may receive access to online assessment systems or learning platforms.
We make reasonable efforts to maintain availability but do not guarantee uninterrupted access due to maintenance, technical faults, cyber incidents, or circumstances beyond our control.
17. Communications
We may communicate with learners by email, telephone, SMS, or through our online platforms regarding:
- Registration;
- Assessment;
- Payments;
- Support;
- Certification; or
- Administrative matters.
Learners are responsible for ensuring that their contact details remain current.
18. Intellectual Property
All website content, assessment templates, learning materials, branding, graphics, and documents supplied by ParaQual remain our intellectual property or that of our licensors.
They may not be reproduced, copied, distributed, or commercially exploited without prior written permission.
19. Limitation of Liability
To the fullest extent permitted by law, ParaQual shall not be liable for indirect, incidental, or consequential losses arising from participation in a qualification or use of our services.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded under UK law.
20. Force Majeure
ParaQual shall not be liable for delays or failure to perform obligations where caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, industrial disputes, internet failures, cyber incidents, governmental actions, or failures of third-party service providers.
21. Privacy
Personal information is processed in accordance with our Privacy Policy and applicable UK data protection legislation.
Information may be shared with awarding organisations or regulatory bodies where necessary for registration, assessment, certification, quality assurance, or compliance purposes.
22. Complaints and Appeals
Learners may submit complaints regarding our services or appeal assessment decisions in accordance with our published Complaints and Appeals procedures.
23. Website Information
We make reasonable efforts to ensure that information published on our website is accurate and up to date. However, qualification specifications, fees, awarding organisation requirements, and membership criteria may change without notice.
Learners should contact us if clarification is required before registering.
24. Amendments
We reserve the right to amend these Terms and Conditions from time to time. Updated versions will be published on our website and will take effect from their stated publication date.
25. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
